THIS MATTER COMING ON TO BE HEARD, and being heard at the July
24, 2000 term of Stanly County Criminal Superior Court upon the
State’s Oral Motion to amend the dates of offenses shown in the indictments in
the above captioned cases from June 7, 1999 to June 6, 1999, the Court, having
heard arguments from the State and the Defendant, and with the Defendant’s
consent, the State’s Motion is hereby GRANTED. The Court makes the following:
FINDINGS OF
FACTS:
1. That the
State informed the defendant’s counsel of the State’s intent to move to amend
these indictments during the week of July 24th, 2000; and,
2. The State’s
proposed amendment does not substantially alter the charges listed in the
indictments in the files numbered 99 CRS 5160, 5161 and 5162;
and,
3. That the
Defendant consents to the amendment.
WHEREFORE THE COURT DOES
ORDER, ADJUDGE AND DECREE that the State’s proposed amendments are
hereby allowed and:
1. The date of
offense in the indictment in 99 CRS 5160 shall read June 6, 1999; and,
2. The date of
offense in the indictment in 99 CRS 5161 shall read June 6, 1999; and,
3. The date of
offense in the indictment in 99 CRS 5162 shall read June 6, 1999.
Order entered the 1st day of August, 2000.
